Email your MP about the transfer of the Building Safety Regulator
Prospect are disappointed that the body transferring out of the Health and Safety Executive, the Building Safety Regulator, will become a non-Crown Non-Departmental Public Body of the Ministry of Housing, Communities and Local Government (MHCLG).
Our members, many of whom are career Civil Servants are concerned by this announcement. We know that there are other regulators and public bodies that have retained Crown status. We have sought clarification as to the reason for this decision, and we are yet to receive a response.
Whilst the new body will be established as a non-Crown NDPB, the transfer is expected to be affected through a Staff Transfer Scheme in accordance with the UK Cabinet Office Statement of Practice on Staff Transfers in the Public Sector. Those employees who are currently assigned to the work that is transferring are expected to transfer to the new body, maintaining their continuity of service, however their terms and conditions of employment are under threat.
As the status of BSR will change, Prospect are calling for the protection of a number of key terms and conditions:
- Access to Civil Service Pension
- Access to Civil Service Jobs
- Retention of Civil Service Redundancy terms
- Ability to move into other Civil Service jobs on internal transfers
